Technology Innovators and Tech-startup Founders often either overemphasise or miss to emphasis the role played by Intellectual Property (IP) management and exploitation planning in the future success of the technology startup company. Protection of new inventions and innovative ideas is critical to building a business case for founding a tech-startup venture. If the idea/technology is meant for adoption in various international countries, then, the registered IP protection planning ought to have been considered earlier.

The right timing is of the essence as to when to consider and plan the appropriate approach of IP protection planning. On one hand, there is a high cost to be incurred for adopting a ‘registered’ types of IP protection (such as patent, registered design, trademark) from the day of ideation till the product/solution being purchased by a buyer thereby generating a sales revenue. On the other hand, maintaining ‘confidentiality’ of trade secrets and knowhow is either difficult or uneasy depending on the adopted commercial exploitation approaches for the product/solution introduction.

The right approach of IP protection and exploitation planning is often needed when the innovation or idea is at an early stage, or there is scarcity of funding sources to meet those IP protection expenses due to unclear/unknown future of the invention at that early stage. Even when registered forms of IP protection have been secured, the high cost of maintaining the ongoing IP protection charges often compels the tech-startups to windup due to inability to meet the running costs of the startup. Having a balance view of ‘how much investment on IP protection aspect is appropriate’ is crucial for maintaining a financial discipline as well as achieving competitive advantage for the tech-startup venture.
